Notice period calculator

The calculation follows the Prior Notice of Dismissal and Resignation Law, 5761-2001, and counts seniority in full months worked up to the day notice is given. A collective agreement, an extension order or a personal contract can set a longer notice period. The result is an estimate; this is general information and does not constitute legal advice.
Notice period: how many days, and for whom
The law applies to both sides
The Prior Notice of Dismissal and Resignation Law, 5761-2001 requires an employer who dismisses an employee to give written notice in advance, and also requires an employee who resigns to give notice to the employer. The length is the same in both cases and depends on seniority and pay type.
Monthly-salaried employees
In the first six months, one day for each month worked. From the seventh month to the end of the first year, 6 days plus two and a half days for each month worked after the sixth. After a full year, one month. For example, a monthly employee with 9 months of seniority is entitled to 6 + 2.5 × 3 = 13.5 days.
Hourly or daily-paid employees
In the first year, one day for each month worked. In the second year, 14 days plus one day for every two months worked in the second year. In the third year, 21 days plus one day for every two months worked in the third year. After three years, one month.
How the days are counted
Notice days are calendar days: rest days and holidays are included. The calculator adds the number of days to the day notice is given and shows the date the period ends. When the result includes a half day, the date is rounded up.
Payment in lieu of notice
An employer who did not give notice, or who waived the employee's work during the notice period, must pay the employee compensation equal to the regular wage for the period for which notice was not given. An employee who resigned without giving notice owes the employer similar compensation. At final settlement, also check unused leave to be paid out and recuperation pay.
Questions about notice periods
Does notice apply to resignation too?
Yes. The law also requires an employee who resigns to give notice, of the same length as on dismissal.
How much notice is due after one year?
For a monthly-salaried employee, one month. For an hourly or daily-paid employee, 14 days plus one day for every two months worked in the second year; a full month only after three years.
Do Saturdays and holidays count?
Yes. Notice days are calendar days, including rest days and holidays.
What happens if no notice is given?
The side that did not give notice owes compensation equal to the regular wage for the period for which notice was not given.
